At IQRally LLC ("IQRally," "we," "our," or "us"), we respect your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our websites and services (collectively, the "Services").

1. INFORMATION WE COLLECT

  • Account Creation Information: Details provided when registering for a user account.

  • Usage Data & Analytics: Details about how you’re using the platform (e.g., IP address, browser type, pages visited, activity logs).

  • Device Information: Location data if applicable.

  • Payment Processing: Transaction data collected by third-party provider.

  • Miscellaneous Information: Other information you may choose to provide to us such as questionnaires, messaging, surveys etc.
     

We may also collect data submitted to us by clubs on behalf of their members.

2. HOW WE USE INFORMATION

We use your information to:

  • Provide, manage, and improve the Services of the platform.

  • Authenticate users and facilitate secure login.

  • Process payments via third-party provider.

  • Analyze user behavior via third-party tools.

  • Communicate with users and send service notifications via third-party tools.

3. LEGAL BASES FOR PROCESSING

We process personal information:

  • With your consent.

  • To fulfill contractual obligations (e.g., club services).

  • To comply with legal requirements.

  • For legitimate business interests (e.g., fraud prevention, analytics).

4. CHILDREN’S PRIVACY

IQRally does not knowingly collect data from children under 13. If we learn that we have inadvertently collected personal information from a child under 13, we will delete it promptly.

Clubs are responsible for ensuring compliance with applicable laws when registering minors.

5. DATA SHARING & THIRD PARTIES

We do not sell your data.

We share information only with trusted third-party vendors who support our services, including:

  • Payment processing and service providers.

  • User authentication and technology service providers.

  • Hosting and analytics service providers

  • Communications and business transfer service providers. 

We require all third parties to safeguard your information appropriately.

6. INTERNATIONAL DATA TRANSFERS

If you are located outside the United States, please be aware that your data may be transferred to and processed in the United States. We will comply with applicable data protection laws such as GDPR when serving international users.

7. DATA SECURITY

We implement reasonable safeguards to protect your data, including encryption and secure authentication. However, no system is 100% secure, and we cannot guarantee the absolute security of your information.

8. USER RIGHTS

Welcome to IQRally! These Terms of Use (“Terms”) govern your access to and use of the services, software, websites, and applications (collectively, the “Services”) provided by IQRally LLC (“IQRally,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Services.

1. WHO WE SERVE

We provide software solutions to sports clubs and facilities, primarily in the pickleball and racquet sports space, as well as their end customers.

There are two types of users:

  • Club Customers: Facilities or organizations who subscribe to IQRally to manage operations.

  • Player End Users: Individuals who interact with IQRally through a club’s account (e.g., to register for sessions, make payments, etc.).

2. ACCOUNT REGISTRATION & ELIGIBILITY

  • Clubs must execute a Master Services Agreement (MSA) and an Order Form to access the full range of IQRally’s features and manage their facility’s presence on the platform.

  • Players may create their own individual accounts via the IQRally player portal, which allows them to browse, book, and pay for available sessions at their home club or at other participating clubs.

  • All players, whether or not they are members of a specific club, are bound by these Terms and must comply with IQRally’s platform rules, policies, and acceptable use standards.

  • Minors under 13 are not permitted to register. Minors aged 13–17 must have parent or guardian consent.

3. USE OF THE SERVICES

You agree to:

  • Use the Services only for lawful purposes;

  • Maintain the confidentiality of your login credentials

  • Not use the platform to harass, threaten, or transmit hate speech or any content that is unlawful, abusive, or discriminatory;

  • Not reverse-engineer, decompile, or copy the software or attempt unauthorized access.
     

IQRally reserves the right to suspend or terminate access to users or clubs who violate these Terms or misuse the platform.

4. PAYMENTS & REFUNDS

  • Clubs are billed according to their Order Form.

  • Players pay their club directly through IQRally’s payment gateway. IQRally does not issue refunds to players, refunds are at the sole discretion of the individual club.

  • IQRally is not responsible or liable for any disputes between a club and its members regarding payments, refunds, or scheduling.

5. THIRD-PARTY INTEGRATIONS

We may use third-party vendors including:

  • Payment processing

  • Authentication

  • Communication services

  • Hosting and analytics tools
     

These services are subject to their own terms and policies. IQRally is not liable for their acts or omissions.

6. DISCLAIMERS & LIMITATION OF LIABILITY

  • IQRally does not manage or operate the physical clubs using the platform. We are not responsible for any injuries, damages, or disputes that occur at or with a club.

  • We make no warranties about the availability, reliability, or fitness of the Services for a particular purpose.

  • To the maximum extent permitted by law, IQRally is not liable for indirect, incidental, or consequential damages arising out of your use of the Services.

7. PRIVACY

Your use of the Services is also governed by our Privacy Policy which explains how we collect and use your data.

8. TERMINATION

IQRally may suspend or terminate your access at any time, for any reason, including if you violate these Terms or applicable law.

9. GOVERNING LAW

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. All disputes shall be resolved in the state or federal courts located in Hudson County, NJ.

10. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
